San Diego Divorce Attorneys

Southern California Divorce Lawyers

Going through a divorce of any kind is usually difficult and emotionally exhausting. Although some marriages may end amicably and with the least amount of dispute, many divorces require attorneys and certain legal proceedings to help with property division, spousal support, child custody and child support. These issues may be able to be resolved (and most often are) outside of the courtroom, but they still require the attention of a skilled divorce lawyer who can serve to protect your interests and your family’s future. At Legion Counsel, our San Diego divorce attorneys are dedicated to protecting our clients’ rights by helping them get the best outcome possible for their divorces.

If you are considering terminating your marriage, it is essential to talk to a divorce attorney immediately. Even if you and your spouse may agree on all the terms of the divorce (such as in an uncontested divorce), a lawyer will need to ensure everything is in order and that all bases are covered. If you and your spouse cannot agree on the terms of divorce (as in a contested divorce), you will most certainly need a divorce attorney who can make sure your interests are protected throughout the entire process.

There are two routes a San Diego, California contested divorce may take:

Mediation – this is a less formal meeting wherein spouses attempt to come to an agreement regarding the terms of a divorce. The mediation is usually attended by the spouses, their attorneys and a neutral third person who acts as a mediator.
Litigation – this refers to actual court proceedings, necessary when a resolution cannot be arrived at during mediation and a divorce case is brought to trial in a California court.

No-Fault Divorce in California

California is a “no-fault” divorce state, meaning that spouses do not necessarily have to have grievance against the other (such as adultery, abuse, or more). Many San Diego marriages end due to “irreconcilable differences,” which are any grounds the divorce court may deem substantial enough for the marriage to end. In fact, if one spouse wants a divorce and the other doesn’t, under California’s no-fault laws, a divorce may still be sought out and granted.
