Family Law Questions and Answers
Do I absolutely need a divorce attorney? If you and your spouse have already decided upon everything and have no arguments about the distribution of property, child custody, child support and alimony, you may not need to go through a lengthy divorce in court. However, having an experienced divorce attorney ensure everything is in order is a valid precaution, to avoid trouble or problems in the future.
Do I need to have “grounds” for a divorce? In California, you can get a divorce simply on the basis of irreconcilable differences; without a certain time period of separation. This is part of California’s no-fault divorce law, meaning that you are not required to have suffered a grievance (such as adultery, abuse, etc.) to file for divorce, as some other states require.
What if I am getting divorced and have no children? Although the process will be less complex (as child custody will not have to be decided), alimony and property distribution will still need to be sorted out. These items alone could cause much worry, particularly if one spouse did not earn any money throughout the relationship.
Do all divorces need to end up in the courtroom? No. In fact, if our family law lawyers can help you avoid having to go to court, we will. After all, trying to resolve divorce issues in a courtroom is a lengthy process that can cause already high emotions to skyrocket, and cause unnecessary upset to your children, if you have any.
How do I know if I need to pay child support or spousal support? That will depend upon your specific case, and the skill of your divorce lawyer. These factors will be determined on the length of your marriage, your income, contribution to the marriage, and much more.
How can I make sure I get custody of my children? Unfortunately, there is no way to guarantee that you will get child custody. The only thing you can do is make sure you act quickly in working with a lawyer who can bring enough evidence forward that proves you are the best parent to provide primary care for your child.
